
Replacement Dwelling in Green Belt
We recently gained planning permission for a replacement dwelling in the Surrey Green Belt for a new dwelling following demolition of the existing.
Set on a private drive the new dwelling had a floor area of 382m2 compared to the existing dwelling which had a floor area of 178m2. This represented an increase in size of 204m2 (115%). Although Green Belt policy allows for replacement dwellings in the Green Belt, their size is restricted to not being ‘materially larger’ than the building it replaces.
We successfully argued to the Local Planning Authority that the proposed increase, which was agreed to be ‘materially larger’ was acceptable as it represented an alternative to large scale extensions which could have been undertaken as ‘permitted development’. These extensions had a total area of 206m2 and had already been confirmed as benefiting from planning permission through the granting of a Certificate of Lawfulness which IPL had previously applied for on behalf of the land owner.
